Bu yollardan ilki istifa etmektir. Baz\u0131 durumlarda ise i\u015fveren belirli ko\u015fullar sa\u011fland\u0131\u011f\u0131nda ve yasal olarak gerek\u00e7eleri bulundu\u011funda i\u015f\u00e7iyi i\u015ften \u00e7\u0131karabilir. \u0130\u015f kanununda belirlenen ve kanunlar \u00e7er\u00e7evesinde bulunan yasal olarak i\u015ften \u00e7\u0131kar\u0131lma durumlar\u0131 harici i\u015ften \u00e7\u0131kar\u0131\u015flar i\u015f verenleri s\u0131k\u0131nt\u0131ya d\u00fc\u015f\u00fcrmektedir. \u0130stifa dilek\u00e7esi olmadan i\u015ften \u00e7\u0131kar\u0131lma durumu bunlar\u0131n ba\u015f\u0131nda gelir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015f\u00e7inin i\u015ften \u00e7\u0131kmaya zorlanmas\u0131 ve mobing uygulamalar\u0131 i\u015f veren taraf\u0131nda b\u00fcy\u00fck sorunlar yarat\u0131r. \u0130stifa dilek\u00e7esi olmadan i\u015ften \u00e7\u0131kar\u0131lma durumunda iki taraf i\u00e7in incelemeler ger\u00e7ekle\u015ftirilmeli ve yasal d\u00fczeyde kan\u0131tlar sunulmal\u0131d\u0131r. \u0130\u015f veren taraf\u0131ndan istifa dilek\u00e7eniz olmadan i\u015ften \u00e7\u0131kar\u0131l\u0131yorsan\u0131z, dava edebilir ve i\u015fe geri d\u00f6n\u00fc\u015f\u00fcn\u00fcz\u00fc talep edebilirsiniz.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u0130\u015f\u00e7inin \u0130\u015ften \u0130stifa Etmi\u015f G\u00f6sterilerek \u00c7\u0131kar\u0131lma Durumu<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015f kanunun inceledi\u011fi dallardan biri de istifa dilek\u00e7esi olmadan i\u015ften \u00e7\u0131kar\u0131lma. \u0130\u015f verenlerin Sosyal G\u00fcvenlik Kurumu sistemi \u00fczerinden ger\u00e7ekle\u015ftirdi\u011fi i\u015ften \u00e7\u0131karma eylemi mutlaka i\u015f\u00e7iye bildirilmelidir. \u0130stifa dilek\u00e7esi olmadan i\u015ften \u00e7\u0131kar\u0131lan i\u015f\u00e7inin k\u0131dem tazminat\u0131na ve ihbar tazminat\u0131na hakk\u0131 oldu\u011fu asla unutulmamal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130stifa dilek\u00e7esi olmadan i\u015ften \u00e7\u0131kar\u0131lan i\u015f\u00e7i ise i\u015f\u00e7i mahkemesine ba\u015fvurabilir. \u0130\u015f\u00e7i taraf\u0131ndan d\u00fczenlenmeyen istifa dilek\u00e7esi \u00f6zel belgede sahtecili\u011fe girmektedir. T\u00fcrk Ceza Kanunun 207 maddesince incelenen belgede sahtecili\u011fin davas\u0131 halinde cezas\u0131 ise alt s\u0131n\u0131r\u0131 1 y\u0131l ve \u00fcst s\u0131n\u0131r\u0131 3 y\u0131l olan hapis cezas\u0131d\u0131r. Bunlar\u0131n yan\u0131nda istifa dilek\u00e7esi olmadan istifa etti g\u00f6sterilen i\u015f\u00e7inin haklar\u0131 \u015fu \u015fekildedir.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>\u00dccret alaca\u011f\u0131: \u0130\u015fveren i\u015f akdini sonland\u0131rd\u0131ktan sonra i\u00e7eride bulunan maa\u015f\u0131n\u0131z\u0131n hak edilen k\u0131sm\u0131n\u0131 sizlere \u00f6demek zorundad\u0131r.<\/li><li>K\u0131dem Tazminat\u0131: \u0130\u015f\u00e7inin kendi istifas\u0131 k\u0131dem tazminat\u0131 hakk\u0131n\u0131 yok eder. Ancak istifa etti g\u00f6sterilen i\u015f\u00e7inin k\u0131dem tazminat alaca\u011f\u0131 vard\u0131r.<\/li><li>\u0130hbar Tazminat\u0131: Zorlanarak i\u015ften \u00e7\u0131kar\u0131lmalarda i\u015f veren taraf\u0131ndan \u00f6denmesi gereken tazminat t\u00fcr\u00fcd\u00fcr. \u0130stifa dilek\u00e7eniz olmamas\u0131 durumunda \u00f6demesi ger\u00e7ekle\u015fmelidir.<\/li><li>\u0130\u015fe \u0130ade Davas\u0131 A\u00e7ma Hakk\u0131: \u00e7inin i\u015f g\u00fcvencesi h\u00fck\u00fcmlerinden yararlanabilmesi i\u00e7in ise;<\/li><li>\u0130\u015f yerinde 30 ve \u00fczeri i\u015f\u00e7i \u00e7al\u0131\u015fmas\u0131 gerekir.<\/li><li>Belirsiz s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7i olmas\u0131 gerekir.<\/li><li>\u0130\u015fverene ait i\u015fyerinde 6 ay veya daha fazla k\u0131dem s\u00fcresini doldurmu\u015f olmak gerekir.<\/li><\/ul>\n","protected":false},"excerpt":{"rendered":"<p>\u0130\u015fe giri\u015f ve \u00e7\u0131k\u0131\u015f i\u015flemleri, i\u015f\u00e7i ve i\u015fveren aras\u0131ndaki yasal s\u00fcre\u00e7lerin belgeler ile kan\u0131tlanarak tamamlanmas\u0131 durumunda ger\u00e7ekle\u015fir. \u0130\u015ften \u00e7\u0131k\u0131\u015f i\u015flemleri farkl\u0131 yollardan sa\u011flanabilmektedir.
