G\u00fcn\u00fcm\u00fczde bir\u00e7ok insan kendi ya\u015fama alan\u0131n\u0131 olu\u015fturman\u0131n yan\u0131 s\u0131ra yat\u0131r\u0131m olarak da g\u00f6rd\u00fc\u011f\u00fc i\u00e7in konut edinebilmektedir. Konutlar\u0131n\u0131 kiraya veren ev sahiplerinin en merak etti\u011fi husus kiras\u0131n\u0131 d\u00fczenli \u00f6deyen kirac\u0131n\u0131n nas\u0131l tahliye edilece\u011fi sorusudur. Bu hususta kanun hem ev sahibini hem de kirac\u0131y\u0131 ma\u011fdur etmemek \u00fczere genel bir \u00e7er\u00e7eve belirlemektedir.<\/p>\n\n\n\n<p>Belirlenen \u00e7er\u00e7evede \u015fayet ev sahibinin birinci dereceden yak\u0131nlar\u0131n\u0131n (e\u015f, ebeveyn, \u00e7ocuklar) konut ya da i\u015fyeri ihtiyac\u0131 varsa ev sahibi s\u00f6zle\u015fmenin tek tarafl\u0131 feshi i\u00e7in dava a\u00e7abilmektedir. Davan\u0131n a\u00e7\u0131labilmesi i\u00e7in ilgili taraflara 30 g\u00fcn i\u00e7erisinde fesih bildirimi yap\u0131lmas\u0131 gerekmektedir.<\/p>\n\n\n\n<p>6098 say\u0131l\u0131 kanuna g\u00f6re:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"a\"><li>Gereksinim, yeniden in\u015fa ve imar<\/li><\/ol>\n\n\n\n<p>MADDE 350- Kiraya veren, kira s\u00f6zle\u015fmesini;<\/p>\n\n\n\n<p>1. Kiralanan\u0131 kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut ya da i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa,<\/p>\n\n\n\n<p>2. Kiralanan\u0131n yeniden in\u015fas\u0131 veya imar\u0131 amac\u0131yla esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da de\u011fi\u015ftirilmesi gerekli ve bu i\u015fler s\u0131ras\u0131nda kiralanan\u0131n kullan\u0131m\u0131 imk\u00e2ns\u0131z ise, belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sona erdirebilir.<\/p>\n\n\n\n<p>b. Yeni malikin gereksinimi<\/p>\n\n\n\n<p>MADDE 351- Kiralanan\u0131 sonradan edinen ki\u015fi, onu kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut veya i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa, edinme tarihinden ba\u015flayarak bir ay i\u00e7inde durumu kirac\u0131ya yaz\u0131l\u0131 olarak bildirmek ko\u015fuluyla, kira s\u00f6zle\u015fmesini alt\u0131 ay sonra a\u00e7aca\u011f\u0131 bir davayla sona erdirebilir. Kiralanan\u0131 sonradan edinen ki\u015fi, dilerse gereksinim sebebiyle s\u00f6zle\u015fmeyi sona erdirme hakk\u0131n\u0131, s\u00f6zle\u015fme s\u00fcresinin bitiminden ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava yoluyla da kullanabilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Yeni Ev Sahibi Kirac\u0131y\u0131 Tahliye Edebilir mi?<\/h2>\n\n\n\n<p>Konut m\u00fclkiyetinin de\u011fi\u015fti\u011fi yeni ev sahibi durumlar\u0131nda da \u015fayet ev sahibi kendi yahut birinci dereceden yak\u0131nlar\u0131n\u0131n kullan\u0131m\u0131 i\u00e7in kirac\u0131n\u0131n tahliyesini isteyebilmektedir. Burada konut ev yahut i\u015fyeri olarak kullan\u0131labilmektedir. Bunu yapmak isteyen yeni m\u00fclk sahibinin 30 g\u00fcn i\u00e7erisinde kirac\u0131ya bu bildirimi yaz\u0131l\u0131 olarak vermesi gerekmektedir. Bildirim yaz\u0131l\u0131 olarak verildikten 6 ay sonra dava a\u00e7\u0131lmaktad\u0131r. A\u00e7\u0131lan dava sonucunda kirac\u0131 evden tahliye edilir. Ancak bu durumda yeni m\u00fclk sahibinin m\u00fclk\u00fc sat\u0131n ald\u0131ktan sonraki 1 ay i\u00e7erisinde kirac\u0131ya yaz\u0131l\u0131 bir bildirimde bulunmas\u0131 \u015fartt\u0131r.
