How statutory inheritance works in Turkey
The Turkish Civil Code ranks heirs by parentela (classes). The first class is the deceased’s descendants; if there are none, the estate passes to the parents and their descendants (siblings). The surviving spouse inherits alongside every class, and the spouse’s share depends on which class they share the estate with: one quarter with descendants, one half with parents and siblings, three quarters with grandparents, and the whole estate otherwise.
Forced heirship (reserved shares)
A will or lifetime gifts cannot override the reserved shares: half of the statutory share for descendants, a quarter for each parent, and for the spouse the whole statutory share (or three quarters in other cases). Siblings have had no reserved share since 2007. Heirs whose reserved share is infringed can bring an action for reduction.
For foreign nationals, Turkish courts generally apply the deceased’s national law to the estate, but Turkish law always governs immovable property located in Türkiye. Read our guide on inheritance law in Turkey for foreigners.
