Decisions of ministries, municipalities and other public bodies can be challenged before the administrative courts. The deadline is usually sixty days — thirty days before the tax courts — and it does not wait for you to gather every document.

Being based in Ankara, close to the Council of State and central administration, we handle administrative and tax disputes for companies, investors and individuals across Türkiye.

Annulment actions

An annulment action challenges the legality of an administrative act in terms of competence, form, grounds, subject matter and purpose. It must be filed within sixty days of notification. If the act is annulled, the administration must comply within thirty days.

Full-remedy (compensation) actions

Where an administrative act or activity causes loss, the claimant first applies to the authority within one year of learning of the act and in any case within five years; if rejected or unanswered, a full-remedy action is filed within sixty days.

Stay of execution

The court may suspend the act pending judgment if it is clearly unlawful and its implementation would cause harm difficult or impossible to remedy. Stay decisions are critical in demolition orders, licence cancellations and debarments.

Civil servants and disciplinary matters

We represent civil servants in disciplinary, appointment, promotion and dismissal disputes. A disciplinary penalty imposed without taking the employee’s defence, or after the limitation period, is annulled on that ground alone.

Zoning, permits and administrative fines

Zoning plans, building permits, demolition orders, sealing decisions and administrative fines under the Zoning Law are challenged before the administrative courts. Administrative fines under the Misdemeanours Law are generally challenged before the criminal judgeship of peace within fifteen days.

Tax assessments and penalties

Tax assessments and tax penalties arising from tax audits are challenged in the tax courts within thirty days of notification. The audit report and the evidence on which it relies — particularly allegations of fictitious invoices — must be examined line by line.

Tax settlement and tax litigation

Before litigation, the taxpayer may seek reconciliation (uzlaşma) with the tax administration. Choosing between reconciliation and litigation depends on the strength of the case and the penalty exposure.

Frequently asked questions

Can a foreign company sue a Turkish ministry?

Yes. Foreign individuals and companies have the same right to challenge administrative acts. Courts may require security for costs from foreign claimants in some cases.

How long do administrative cases take?

First-instance decisions often take one to two years; stay of execution requests are usually decided much sooner.
